WHITE TIGER TAEKWONDO & MARTIAL ARTS

Your membership entities the member to use the following facilities and services on the days indicated (except for days we’re closed): The enrollee, hereinafter referred to as “student(s)” desires to enroll in (or in the case of a minor, wishes to be enrolled by a parent of legal guardian) in White Tiger Taekwondo, and whereas White Tiger Taekwondo, (hereinafter referred to as White Tiger Taekwondo) wishes to have the student enroll in White Tiger Taekwondo.

Term of membership.  The student hereby is enrolled as a member of White Tiger Taekwondo for a period of time selected commencing now and terminating on the time specified in the selection. 

How to pay.  To pay in installments, you are requesting us to establish an Automatic Bank Draft or a monthly charge to a credit card. The first monthly payment and registration fee is paid through the paypal button. The office will then set up your choice method of continuing monthly payments, minus the registration fee which is only paid the first month. Consecutive memberships without lapse will not be subject to a registration fee again.

The following disclosures are required by law and are part of this contract and you agree to make you payment according to the payment schedule which follows: Member represents that he or she is in good physical condition and able to use the equipment provided and to participate in exercises and martial arts programs made available by White Tiger Taekwondo. White Tiger Taekwondo represents that its personnel are certified and trained in providing martial arts instruction and the proper use of our equipment.

White Tiger Taekwondo further represents that its personnel have no expertise in diagnosing, examining or treating medical conditions of any kind or in determining the effect of any specific exercise on said medical condition. Member full understands and agrees that in participating in one or more of the martial arts programs, or using the facilities maintained by White Tiger Taekwondo, there is possibility of accidental or other injury. Member agrees to assume the risk of such injury and further agrees to indemnify White Tiger              Taekwondo from any and all liability on the part of White Tiger Taekwondo by either the member or third party as the result of the use by the member of the facilities and instructions offered by White Tiger Taekwondo.

Included in your membership agreement: If you are receiving free or discounted membership or equipment as a condition of your membership agreement, it is only valid with the completion of the membership terms. If this membership agreement is not fulfilled by buyer for any reason, the buyer will be responsible to pay the difference in membership related discounts and equipment issued. The bank account listed above will be charged the prorated membership for the months active, any membership related fees and the equipment issued as part of your package price.

Regular rate of monthly tuition per person is $189 per month. Registration is $75 for each person. Weight room memberships are an extra $20, $15 or $10 per month depending upon the program choice. Weight room memberships are available with 12 month or longer memberships. Supervised childcare memberships are an extra $20, $15 or $10 per month depending upon the program choice. Childcare memberships are available with 12 month or longer memberships. Punch cards to use the childcare room per drop in visit are available at the office. Uniforms are priced at $45 to $130 depending upon the style.

Before you enroll in this contract:

This is a contract, and it will become legally binding on you when you enroll by selecting the paypal payment options.  Before you enroll in this contractual agreement, read the terms. By enrolling, you certify that you’ve read and understand your obligations under it.

You the buyer, may cancel this contract at any time prior to midnight of the third business day after the date of this contract.  To cancel, you must notify White Tiger Taekwondo in writing or electronic mail to MasterRondy@gmail.com. You understand that under the terms of this agreement White Tiger Taekwondo obligates itself to furnish you with competent instructors and suitable facilities for teaching the lessons.  All class sessions are supervised by qualified personnel trained in the procedures and tradition of White Tiger Taekwondo.

Testing Fees: To cover the costs of registration, promotion, certificate & new belt, a testing fee is charged at each examination. Testing is optional.

Being a member of White Tiger Taekwondo you will faithfully comply with all the rules and regulations and the traditions of White Tiger Taekwondo.  Failure to take the lessons in the allocated time, without written request and approval, invalidated the lessons beyond the expiration date. You further understand that failure to complete the lessons does not relieve you of your obligation to pay the tuition in full.  Lessons are not conducted on national holidays, days of inclement weather, examination days, special events or on some days of Tournaments held or sponsored by White Tiger Taekwondo.

You understand further that strict observation by you of the rules and regulations relative to your training including the use of protective equipment required by White Tiger Taekwondo, will largely eliminate the possibility of accident or injury and that you waive any claim of damager against White Tiger Taekwondo and/or its principals or instructors in any case resulting from the activity. Student is required to have their own medical insurance.

Paymnt Failure Fee:  If your payment for any payments under this contract are returned for insufficient funds on the second resentment, you will be charged a bad check fee of $25.00, and when applicable, a late charge as well.

Entire Balance Due:  If you don’t make a payment when it is due, we can suspend your membership privileges and require you to pay the entire balance of what you still owe, less any refund to which you are entitled as described above under prepayment.

Default: You will be in default if you haven’t paid us everything you owe by the scheduled end of this contract, or if the entire balance of what you owe becomes due and you don’t pay us.  We may get a court judgement against you for what you still owe and you agree to pay all court costs and reasonable lawyer’s fees involved in collecting this contract ot be set by the court.  Any judgement shall bear interest at the highest rate allowed by law.

Non-Use of Facilities: Even if our facilities and services are not used, you are still responsible for payment under this contract. Make up classes are permitted during your membership term, but memberships may not be extended.

NOTICE OF CONSUMER RIGHTS: If our facilities are unavailable for a period exceeding 1 month, through no fault of ours, we may extend your membership privileges for a period equal to the period during which the facility is unavailable, or give you a pro rate refund. If the facility is unavailable for a period to exceed 1 month, through our fault, you may extend your membership privileges for a period equal to the period during which the facility is unavailable, or obtain a pro rate refund.

If a member becomes disabled during the term of this contract for a period exceeding 1 month and these facts are confirmed in writing by a physician in advance of taking time off, then your membership privileges may be extended for a period equal to the duration of your disability.  However, payments shall continue during the disability period.

Cancellation: Every student has the option to attend White Tiger on an on-going membership and pay the regular price which is drafted monthly. The member may cancel at any time in writing without penalty, the membership will end upon the next draw date. No refunds will be issued for a portion of a month.

Students may also enroll if packages are offered with discounted rates based upon completion of the package. If the Contract is cancelled under the cancellation provision, we will automatically charge you for any and all discounts and free equipment and services you received as part of your completed membership agreement and the difference in price of regular membership dues which is proportionate to the number of months your membership was in effect.

You may cancel your membership at any time for any reason including medical reasons and relocation. All cancellations are handled in the same manner as “Cancellation”.

Members may be offered special discount rates for paying for the entire membership in full. These are “Final Sale” memberships and no portion will be refunded for any reason. 

How To Exercise Your Consumer Rights:  To exercise any of your consumer cancellation rights as stated above, you must send written notice by registered or certified mail (or if you cancel within three business days, you have the option to deliver written notice in person) to White Tiger Taekwondo, 1605 NW Maynard Road, Cary, NC 27513. You may also send e-mail to: MasterRondy@gmail.com.  Memberships are rounded off to the next month - or end at the next payment date.

Our Rules And Regulations:  The member shall follow all of the rules and regulations of whichever facility is being used, including hours of operation which have been made available to you and are posted in the schedule.  We can revoke you membership privileges if these rules and regulations are not followed, and we expressly reserve the right to change these rules, regulations and hours of operation or employees.  In addition, we expressly reserve the right to add to, eliminate, or alter any piece of equipment, furniture or fixture, when deemed necessary or desirable, if, in our judgement, it is in the best interest of our members.

Notices/Protests:  The circulating or posting of petitions, notices, circulars, group protests or picketing, or statements of any kind including social media, is prohibited on the White Tiger Taekwondo premises unless previously approved by management.

Release Of Liability:  Members and their guests in using the facilities and equipment of White Tiger Taekwondo do so at their own risk. White Tiger Taekwondo shall not be liable for any damages arising from person injuries sustained by members and guests, in, on or about the premises of White Tiger Taekwondo.  White Tiger Taekwondo assumes no responsibility for the loss of, damage to, and personal property belonging to a member or guest while on the premises of White Tiger Taekwondo.

Change In Membership Plan:  Membership Agreement upgrades may be prorated and paid in full at White Tiger to avoid rewriting of the agreement.

If you choose to change your membership plan by signing a new contract which includes your old balance in the cost of the new membership, the new contract will void the old contract.  However, cancellation of your new contract will cause your previous contract to remain valid and enforceable. 

Changes In This Contract:  This is the entire agreement covering your purchase from us.  It can only be changed by a writing signed by you and us.  We can waive or delay enforcing any of our rights under this contract without losing them, including and not limited to the yearly imposition of your annual renewal fee increase, and we may impose that increase on a cumulative basis at any time in the future.

Transferring This Contract:  We can transfer this contract to an independent financial institution, or we may refer it to another company for collection.

You cannot transfer your membership privileges unless you have signed an Amendment to Membership Contract, a copy of which you acknowledge receipt, and have complied with all terms and conditions of transfer.

Governing Law:  This contract will be governed by the laws of the State of North Carolina and of the United States.  If any part of this contract is unenforceable, this will not make any other part unenforceable.  This following notice is required by Law.

NOTICE: ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS AND SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF, RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER.
